Sending a copyright notice

Send your notice with the content removal form, choosing “I own the copyright” or “I represent the copyright owner”. Under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), a notice must include:

  1. Your physical or electronic signature, as the copyright owner or a person authorised to act on their behalf (typing your full name is enough).
  2. Identification of the copyrighted work you believe is infringed — for example the title of the original set or a link to where it is published.
  3. The address of each page on PicFap where the material appears (for example https://picfap.com/gallery/…).
  4. Your contact details: name, address or email address, and a telephone number if possible.
  5. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorised to act on the owner’s behalf.

We review notices within 48 hours. Valid notices lead to the removal of the material, and we confirm by email.

Counter-notice

If you believe material was removed by mistake or misidentification, you can send a counter-notice through the same form, including your signature, the address of the removed material, a statement under penalty of perjury that you believe it was removed in error, your name, address and telephone number, and your consent to the jurisdiction of the appropriate court. We forward valid counter-notices to the original complainant.

Repeat infringement

PicFap does not host uploads from the public. Producers whose content is repeatedly the subject of valid notices are removed from the site.

Please be accurate

Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are not sure whether your rights are infringed, consider seeking legal advice first.
